These terms govern your use of cutlark.com and your purchase of digital products from Cutlark Studio. By using this website you accept them.

About us

Cutlark Studio is an independent digital design studio selling transparent PNG artwork and related digital products. In these terms, “we”, “us” and “Cutlark” mean Cutlark Studio, and “you” means the person using the site or buying a product.

The products

Everything sold here is a digital download. No physical goods are produced, packed or shipped, and nothing will arrive by post.

Each product page states the number of files, their pixel dimensions, DPI, format and background type. Preview images show the actual artwork. We aim for these descriptions to be accurate and complete; if something on a product page turns out to be wrong, the Refund Policy covers it.

Colour on screen varies between displays, and printed colour varies between printers, inks and materials. Small differences between what you see and what you print are normal and are not a defect.

Using this website

You may browse the site, use the free tools and read the articles freely.

You may not:

  • attempt to gain unauthorised access to the site or any related system;
  • interfere with the site’s operation, or use automated systems in a way that places an unreasonable load on it;
  • scrape or copy the site’s content for republication;
  • use the site for anything unlawful.

The site is provided as it is. We aim to keep it available and accurate but do not guarantee uninterrupted availability, and we may change or remove content at any time.

The free tools

The tools at /tools run in your browser and are provided free, without warranty of any kind.

They process your files locally on your own device; nothing is uploaded. You are responsible for keeping your own backups. We are not liable for any loss or corruption of files arising from their use, and their output should be checked before it is used in production work.

Purchases and checkout

Checkout does not take place on cutlark.com. The Buy button takes you to Payhip, which acts as merchant of record and handles payment processing and file delivery.

That means:

  • Payhip’s terms and privacy policy apply to the checkout process.
  • Your payment details are handled by Payhip and its payment providers, not by us. We do not receive or store card details.
  • The order confirmation and download link come from Payhip.
  • Prices shown on this site are in US dollars. Any tax Payhip is required to collect is applied at checkout and may be added to the displayed price.

A contract of sale is formed when Payhip confirms your order. We may decline or cancel an order where a product was listed at an obviously incorrect price, where the order appears fraudulent, or where we are unable to fulfil it — in which case any payment taken is refunded in full.

Delivery

Delivery is immediate and automatic through Payhip after payment. If a download does not arrive or does not work, contact us and we will resolve it.

Keep a backup of your files once downloaded. Download links may expire; if you lose access, email us from the address used at checkout and we will help.

Licence and intellectual property

All artwork, images, text, page designs and code on this site are owned by Cutlark Studio or used with permission, and are protected by copyright.

Buying a product gives you a licence to use the artwork, set out in full on the Licence page. It does not transfer copyright or ownership. In summary: commercial use of finished products is included; reselling or redistributing the source files is not.

The Cutlark name and wordmark are ours and may not be used without permission.

Prohibited use of the artwork

You may not use Cutlark artwork in material that is unlawful, defamatory, hateful, obscene, or that infringes anyone’s rights; nor register it, or a design consisting substantially of it, as a trademark; nor include it in any product whose value comes from the artwork being reusable by the buyer. The Licence page sets out the full list.

Refunds

See the Refund Policy. In short, digital downloads are not generally refundable once downloaded, but defective, incomplete or misdescribed files are put right or refunded, and your statutory rights are unaffected.

Limitation of liability

To the extent the law allows:

  • The website, the free tools and the products are provided without warranties other than those that cannot legally be excluded.
  • We are not liable for indirect or consequential loss, or for lost profits, lost sales or lost data arising from use of the site, the tools or the artwork.
  • Where we are liable, our total liability in relation to a product is limited to the amount you paid for it.

Nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are not affected.

This site links to third-party services, including Payhip. We are not responsible for their content, terms or practices, and a link is not an endorsement.

Changes to these terms

These terms may be updated, and the date at the top shows when they last changed. The version in force at the time of your purchase governs that purchase. Continuing to use the site after a change means you accept the updated terms.

Governing law

These terms are governed by the law of the jurisdiction in which Cutlark Studio operates. If you are a consumer, you keep the protection of the mandatory consumer law of your own country of residence, and may bring proceedings there.
